Are ChatGPT conversations legally privileged in Australia?

Privacy, confidentiality and legal professional privilege are different. An ordinary AI conversation should not be assumed to be legally privileged.

Short answer: Not automatically. ChatGPT is not the user’s lawyer, and privilege depends on the purpose, confidentiality, lawyer-client relationship and surrounding facts. Adding a lawyer afterwards does not necessarily transform earlier independent AI work into privileged communication.

Three different questions

The practical danger

A person may disclose allegations, evidence, personal information and strategy before asking whether the environment supports the legal protection they expected. The legal context should therefore be established first rather than asserted retrospectively.

What Privileged AI changes

The core sequence is matter creation, explicit lawyer request and recorded lawyer acceptance before the substantive AI workspace opens. The system then keeps the AI work, documents and evidentiary record associated with that matter.

Establish the matter before sensitive AI work

Privileged AI is designed to place AI-assisted preparation inside a named, lawyer-connected matter, with the research, documents, access history and audit record kept together.

Important: Privileged AI does not itself provide legal advice, and software, payment or a label cannot automatically create legal professional privilege. Privilege depends on the facts, confidentiality, purpose, lawyer relationship and applicable law.
